Terms of service

These terms apply to the wedding film service provided by Dear Ever ("we"), covering both film types: growing-up films and wedding & pre-wedding films. By using the service, you agree to them.

1. The service

We create a wedding film from the photos and names you provide, in the film type and style you choose, delivered as a 1080p MP4. You sign in with Google or an emailed code, one account per email address, and can delete a film at any time in My films.

2. Price and payment

Each film costs HK$599. Payment is due before the final film is created.

3. Draft previews

Before paying, you may preview your film for free as often as you like, changing photos, order and names at any time.

4. Changes after delivery

Within 14 days of delivery, we will re-create the final film once free of charge to change names or photo order. Adding or removing photos is not included.

5. Delivery

We provide a download link for the final film within 3 working days of payment.

6. Refunds

• Orders cancelled before the final film is created are refunded in full.
• After delivery, if the film has a technical fault (for example, it will not play or the picture is corrupted) that we cannot fix, we refund in full.
• After delivery, refunds are not available for a change of preference.

7. How the film may be used

The film may be played at your wedding and private occasions, and shared privately with family and friends. It may not be used commercially, and its music may not be extracted for other use. The music is licensed for these private uses only; if you upload the film to a public platform, the platform may mute or restrict it through copyright detection, and we cannot guarantee public publication. If the film uses music you uploaded yourselves, its use is limited to the licence you hold for that music; we grant no licence for it.

8. Your uploads and responsibilities

By uploading photos, music or other content ("your uploads"), you confirm and warrant that:

• you have the right to upload your uploads and use them in your film, and you hold every licence, permission and consent this needs, including the copyright and recording rights in any music and the consent of the people in your photos;
• your uploads do not infringe anyone's rights, including copyright, privacy and publicity rights;
• your uploads contain no viruses or malicious code;
• your uploads break no law, including laws on defamation, harassment, privacy, intellectual property, obscenity and child protection.

You give us a non-exclusive, royalty-free licence to store, copy, process and modify your uploads as far as the service needs (for example resizing photos, cutting silence from the start and end of a song, adjusting its volume) and to place them in your film. This licence ends when your uploads are deleted under the privacy policy. Rights in your uploads remain with their owners.

You will be responsible for, and hold us harmless from, every claim, action or demand by a third party, and every resulting liability, loss and cost (including reasonable legal fees), that arises from your uploads, from a film made with them, or from a breach of the warranties above.

9. Styles and design

The backgrounds, frames, music and other design elements of each style belong to Dear Ever or its licensors.

Default soundtrack: Clair de lune (composed by Claude Debussy), piano by Laurens Goedhart, used under CC BY 3.0 (source). We cut the silence at the start of the recording and adjusted its volume and peaks.

10. Limitation of liability

To the extent permitted by law, our liability for the service is limited to the amount you paid for the film concerned.

11. Changes to these terms

We may update these terms from time to time and will publish the updated version on this page with its date. Paid orders follow the terms in force at the time of payment.

12. Governing law

These terms are governed by the laws of the Hong Kong Special Administrative Region.
